01What ChoosinTexasEmo does

ChoosinTexasEmo turns a photo you upload into a short AI video using a ready-made effect. The home page shows sample clips, what kind of photo to upload, the options you can choose, what each costs in credits, and which AI models are used.

Videos are made by third-party AI models. Results vary from photo to photo, and we cannot promise a particular look, quality or level of detail.

02Who can use it

• You must be at least 18 years old, or the age of majority where you live if that is higher.
• You sign in with a Google account or with your email address and a password. Keep your sign-in details secure: you are responsible for what happens under your ChoosinTexasEmo account. Tell us at support@choosintexasemo.com if you think someone else has used it.
• One person per account. Do not share, sell or transfer your account.
• If you use ChoosinTexasEmo for a business, you confirm that you may accept these terms on its behalf.

03Credits and prices

• Making a video costs credits. The cost depends on the quality you pick, and is shown before you press Generate.
• You buy credits in packs on the pricing page. Each pack is a one-time payment. There is no subscription and nothing renews automatically.
• Credits never expire while your account is open. They cannot be exchanged for cash, transferred to another account or sold.
• Credits are taken when a video starts. If the video fails, times out or is stopped by our safety checks, the credits go back to your balance automatically.
• A video that is delivered counts as used, even if you do not like how it turned out. That is why the home page shows samples first.
• Prices can differ between visitors, for example by country, currency or during a promotion. The price you pay is the one shown at checkout.

04Payment through Waffo Pancake

Purchases are processed by Waffo Pancake, which acts as merchant of record and reseller for each transaction. Waffo Pancake takes the payment, adds and collects sales tax or VAT where required, and sends your receipt. The Waffo Buyer Terms also apply to your purchase.

On your card statement the charge may show as Waffo Pancake (WAFFO) or VidSpirit. We never see or store your full card number. VidSpirit remains responsible for the ChoosinTexasEmo service and your credits.

Before you buy, you tick a box to confirm you accept these terms and the Refund Policy.

05Refunds

In short: credits you have not used can be refunded within 7 days of purchase, credits spent on delivered videos cannot, and failed videos give their credits back automatically. The full rules and how to ask are in the Refund Policy.

06Billing problems and chargebacks

If a charge looks wrong, email support@choosintexasemo.com with the email address of your account and your receipt before contacting your bank. We reply within 3 business days, and confirmed billing errors are refunded in full.

If you open a chargeback or payment dispute for a purchase you made, we may pause your account while it is open. Accounts with repeated refund requests, chargebacks or disputes may be suspended or closed (see Closing accounts).

07Your photos and videos

• You keep the rights to the photos you upload. You give us permission to store them, check them and send them to our AI providers only to make your videos and keep the service safe.
• You own the videos you make, as far as the law allows, and may use them for any lawful purpose, including on social media. Other people may create similar videos from the same effect.
• We do not use your photos or videos to train AI models, and we do not show them to other users.
• Photos and videos are deleted automatically after the periods in our Privacy Policy. Download anything you want to keep.

08Acceptable use

Only upload a photo if it shows you, your own property, or someone (or something) you have permission to use this way. Everyone in a photo must be 18 or older: do not upload photos of children, even with a parent's consent. Permission never makes the content below acceptable.

You may not use ChoosinTexasEmo to upload, create or share:

• Sexual content: sexual or NSFW content of any kind, including nudity and "undressing" a person.
• Violence and gore: violent or gory content, or content that promotes violence, terrorism or self-harm.
• Hate: hate speech, or content that harasses, threatens or demeans people because of who they are.
• Child safety: anything that sexualises or endangers children, or shows anyone who appears to be a minor in a sexual or harmful way. We report child sexual abuse material to the authorities.
• Deepfakes and impersonation: swapping faces, putting real people into intimate scenes with each other, or showing a real person doing or saying something they did not do, even with their consent. This includes photos of celebrities, politicians or other public figures, and videos that make it look like a public figure appears in, endorses or says something, even if you think you have permission.
• Copyright and trademarks: content that infringes someone else's copyright, trademark, privacy or publicity rights, such as other people's photos you have no right to use, or brand logos and characters you do not own.

You also may not present a video as real footage to deceive people, break the law, attack or overload the service, get around our limits or safety checks, scrape it, or resell access to it.

09How we check content and what happens when rules are broken

Every photo is checked automatically before any credits are taken, and a photo that fails the check is refused. The AI models that make the videos also apply their own safety filters; a video they stop is not delivered and the credits are returned. We keep a record of these checks.

When someone breaks these rules we may, depending on how serious it is: refuse the photo or video, delete it, limit generation on the account, or suspend or close the account. Content involving the sexual abuse of children leads to an immediate permanent ban and a report to the authorities.

To report a video made on ChoosinTexasEmo, for example one that shows you without your consent, use the report form. A person reviews every report within 48 hours. If the video breaks these rules we take it down: it is deleted together with every other video made from the same photo, and that photo can no longer be uploaded. Reports are never acted on automatically.

To appeal a decision you think is wrong, or to report a user, email support@choosintexasemo.com. We reply within 3 business days.

10Disclaimers and liability

• ChoosinTexasEmo is provided "as is" and "as available". We do not promise that it will always be available, error-free, or that a video will meet your expectations.
• AI-generated videos can contain mistakes, distortions or details that were not in your photo. They are for entertainment and creative use, not a record of real events.
• As far as the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.
• Nothing in these terms limits rights you have under consumer law that cannot be excluded.

11Closing accounts

• You can stop using ChoosinTexasEmo at any time and ask us to delete your account by emailing support@choosintexasemo.com. Ask for a refund of eligible credits first (see the Refund Policy).
• We may suspend or close an account that breaks these terms, is used for fraud or abuse, has repeated refund requests, chargebacks or payment disputes, or when the law requires it. When we close an account for these reasons, its unused credits are lost unless the law says otherwise.
• If we close your account for any other reason, or shut down ChoosinTexasEmo, we refund the credits you paid for and have not used.

12Changes to these terms

We may update these terms as the service changes. The date at the top shows the latest version. If a change matters for you, we will say so on the site before it takes effect. Using ChoosinTexasEmo after a change means you accept the new terms.
